In California, under Peanl Code 242, criminal battery is defined as application of force or any unlawful contact upon the person of another with the specific intent to harm or injure that person. Charges are ordinarily filed pursuant to California Penal Code section 242 or 245. If battery occurs between married couples or two cohabitants or those who have or have had a domestic relationship, Domestic Violence charges or battery on a domestic partner charges may be filed under California Penal Code sections 273.5 or 243(e). If injuries are sustained by the alleged victim, the prosecution may chose to file felony charges against the alleged perpetrator.

Under circumstances where there has been a mutual combat or where there was a quarrel between family members with no resulting injuries, city prosecutors in Los Angeles and other California counties may choose to set the matter for a city attorney hearing in lieu of filing a criminal complaint.
