A common defense to forgery is that the defendant did not intend to deceive for economic or personal gain. This could be shown by “consent” given by the rightful owner of the check or negotiable instrument. Sometimes, a “civil compromise” may be reached whereby the defendant makes full “restitution” to the alleged victim, and in exchange the prosecution agrees to drop the criminal charges. This may require that the defendant make a lump-sum payment to the victim. In more serious forgery cases sometimes the prosecution agrees to eliminate any jail time in exchange for full payment of the loss incurred by the victim.
